In principle, no, but as is often the case, there are exceptions!

The fine is the penalty for contraventions only.

However, according to Art. 3 al. 1 lit c ch. 1 of the Ordinance on the Criminal Record (VOSTRA Ordinance), offences are entered in the criminal record only when the amount of the fine exceeds CHF 5,000.

Thus, a conviction for a fine of CHF 3,000 will not be entered in the criminal record.

Please note that a fine of less than CHF 5,000 may still be entered in the criminal record if :

  • it is a contravention of an Act of Parliament that permits or requires the competent authority to order, in the case of In the case of a repeat offence, a fine of a specified minimum amount or, in addition to a fine, a pecuniary punishment or a custodial sentence (Art. 3 para. 1 lit. c no. 2 O-VOSTRA);
  • in addition to a fine, the authority will impose a ban on carrying out an activity, a ban on contact or a geographical ban (art. 3 al. 1 lit c c. 2 O-VOSTRA).
